Adobe To Be Sued Over Photoshop Healing Brush

Shell and Slate Software, a Carpinteria, Calif.-based company that makes graphics software, filed the suit Monday in the U.S. Federal District Court for the Central District of California.

The case alleges that features in the latest version of Photoshop, Adobe's market-leading image-editing application, infringe on trade secrets held by Shell and Slate. The suit specifically cites the Healing Brush, a sophisticated touch-up tool that was one of the most highly touted new features in Photoshop 7.0.

Shell and Slate was formed two years ago by Ben Weiss, who formerly worked for MetaCreations as one of the main developers of Kai's Power Tools and Kai's Power Goo, imaging editing products that competed with Photoshop. Weiss' lawyer confirmed the lawsuit but declined to comment on it or provide a copy of the complaint.

An Adobe representative confirmed the suit and said the company will challenge it. "We don't believe it has any merit, and we intend to defend ourselves vigorously," the representative said.

they should have copyrighted it or something... i doubt adobe would do this if it were. gosh i hate frivilous lawsuits.

I love it when people call every lawsuit frivolous before they even know the details. That?s for the court to decide, not people who know nothing about the law and nothing about the kind of harm that is being done to our rights as citizens and small business owners as we speak.

The rights of individuals and small businesses are being quickly eroded away by politicians and large corporations and the public doesn't seem to care one bit. It?s going to be too late by the time people finally do realize what the consequences of what?s happening in Washington right now. Just look at the all the bullcrap that was shoved into the ?Homeland Security? bill that congress passed this week. They gave corporations a loophole to screw over consumers, avoid paying taxes and not have to worry one bit about any liability all in the same bill and all supposedly in the name of homeland security. This is outrageous and we?re letting them get away with it.

When a corporation breaks the law it needs to pay the consequences and it need to be a significant enough of a punishment that it will not continue to break the same law or others over and over again. Wake up people? This will affect you whether you think so or not.

Under this bill if you happen to take a medication that is produced by a company that produces ?anti terrorism? drugs like a smallpox vaccine, and that medication that you take has nothing to do with anti terrorism, it could be a heart medication or a asthma medication and if it turns out to be something that is more harmful than helpful to you, and the company knew it was harmful before they started marketing it, then you are out of luck there will be know legal recourse for you, not even if you die because of their negligence, your family will not be able to sue for any damages thanks to this bill and there will be nothing to stop them from continuing to market that drug to other people. Is that the kind of protection that we should be providing to big corporations, many of which do not even pay their fair share of taxes? I think there are other ways that we could encourage the development of anti-terrorism technology without screwing over the general public.

The system has checks and balances for a reason and when remove these checks and balances we the people pay the price. It makes me sick to think that Americans care more about football and a pathetic TV show called ?the bachelor? than they do about the corruption that is occurring at this very moment in our own government.
