Lawsuit filed against Microsoft over MS Points in GFWL

A class action lawsuit against Microsoft has been filed in Philadelphia over the MS Points system used in Games For Windows Live Marketplace.

Apparently, excess points left over after purchasing items cannot be used.

GFWL uses the same points system as Xbox 360, and attorney Samuel Lassoff of Horsham, PA, said Microsoft?s using the system to ?collect revenues for digital goods and services which were not provided? with the system.

Apparently, Lassoff became privy to the issue after receiving an invoice from Microsoft showing ?charges for purchases he couldn?t complete?.

Citing that Microsoft ?engaged in a scheme to unjustly enrich itself through their fraudulent handling?,

Lassoff claims he and ?hundreds? of other Xbox Live users have been overcharged.

?Microsoft breached that contract by collecting revenues for digital goods and services which were not provided,? Lassoff said in his lawsuit, per InformationWeek.

Microsoft has yet to respond to the lawsuit, but last week Aaron Greenberg revealed that the company never intended to ?mislead? folks when using MS Points as currency and is looking into making the points system more transparent.

I always thought it was common knowledge that anytime you charge Currency for a Points based commerce system you Knew you were getting ripped off.

Nintendo does the same thing with their Wii Points. Though, the are more fair about it since a lot of the games are priced to where you actually don't have any left over. Right now I only have 200 points that I can use till I buy more.

As much as I hate the damned points and would be SO happy to see them go, MS is within their rights to have this type of system. As mentioned before, other companies do it as well.

The reason that the Nintendo point system is not in trouble is because 1 point equals 1 penny (cent)

Where as the Microsoft Point system to my knowledge does not run on an exact system they are 80 points for a dollar. Which makes it confusing on the customer when a game costs 2000 points it is $25 where as they might think it only costs $20

In the end it is simply the consumers fault for not looking into these things before purchasing.

I usually cave in and buy crap from the marketplace when I've got leftover items.. Usually just for the avatar. Otherwise I normally let those points sit in there that way they'd eventually build up.

Are GFWL unable to let their unused points sit around awhile or something?
