They are explicit, and they are a binding contract that you are agreeing to no matter where you are. I can understand your argument being applied to something like a patent, but in this case it just doesn't work... File bankruptcy... The court doesn't care, it is their responsibility to award the plaintiff what they determine they are due (Though this sounds kind of high to me as well), not what the defendant can afford.
