EA sued for misleading investors about Battlefield 4

Electronics Arts has been sued by an investor over the release of Battlefield 4 which reportedly has a lot of bugs across all gaming platforms.

An investor has filed a class-action lawsuit with the Court of Northern District of California accusing Electronic Arts of violating federal securities laws by making "materially false and misleading statements" about the development of Battlefield 4. According to the filing, EA and some of its executives knew about the game's bugs and that it would not be a commercial success but provided false information to investors to keep the stock price of the company high during high volume sales.

The filing has been made on behalf of every consumer who purchased the company's stock between July 24 and December 4. The names mentioned in the filing include CEO Andrew Wilson, CFO Blake Jorgenson, EA Labels president Frank Gibeau, EA Games executive vice president Patrick Soderlund, and EA president and COO Peter Moore. At least $1 million worth of shares were sold by the individuals named in the lawsuit except for Jorgenson.

The investor has alleged that EA knew about Battlefield 4's issues but directed the blame towards Sony's firmware through a customer service post which was later retracted. Microsoft has also been investigating post-DLC issues with Battlefield 4.

An EA representative provided a statement to GamesIndustry International saying:

"We believe these claims are meritless. We intend to aggressively defend ourselves, and we're confident the court will dismiss the complaint in due course."

Defiantly said,
Is it buggy on XB1? I see most of these comments pointing towards PC issues. Do these issues/bugs persist on console?

It's horrible. I haven't played my brand new shiny XBOne in about a week because of how buggy this game is. I only have this and Fifa. I tried to have a go on it yesterday but every time I tried to find a game it said I had been disconnected from the session.

Btw, some guys on YouTube are making video of bf2,witch have essentially the same MP problems has bf4 so.. This is not new to the bf franchise, it's just that more people are playing it now. But now they nerfed the close combat, hit do not register anymore, was better before the last patch

Good, at last!

Someone needs to step up and show EA that it's not ok, it's not what they should be doing and that they will get in the sh*** if they try to pull this crap on the investors and the customers.

Hopefully this makes big headlines, they pull their heads out their arses and other publishers take note.

*Sigh*... Is it really on the same level? Such a shame...
I have my share of technical issues with BF4, but haven't played DayZ yet. The Steam page clearly says the game is in early alpha and if we're not confortable with serious flaws and bugs we shouldn't buy it yet. BF4, on the other hand... already had it's first DLC out...

... I'm regretting buying BF4 more and more.

Can't say I disagree. A strong message sent now would discourage this from become an even more popular tactic than it already is. We'll see how it plays out. Things change when you go public and it's not as OK to BS.

Had they kept the game PC only and stopped trying to get so greedy they could have concentrated on one version of the game. Also could have stopped fooling with stats and ranks and just let people play the damn games as they were from 1942 and Vietnam. People forget those games were the best, you loaded it played and that was it. You didn't have people forgetting about game play and team work just to garner stats and virtual medals.

Even if the lawsuit doesn't go for the investors, its still good to get more light on this. DICE should be held accountable as well - they are the ones supporting the game with patches/updates and these have more often than not made the game even worse. Its amazing what EA and its developers have done (not done?) this year.

I'm sure this was mentioned a few weeks ago? At least on Reddit that is.

This isn't Reddit... ? I heard it being possible but not confirmed anywhere.

This game continues to be a joke... Didn't work very well at the start, almost unplayable now after the latest patch... Freaking SLI is broken now... This game at this point is a joke...

Are you having that many problems that are that bad? I play on PC and have an NVidia 780. At release the game would crash ounce every three to four games I played and seemed due to bugs with the sound. Yes, it was ****ty and not fun because I am trying to rank up for unlocks and when the game crashes my wheels are turning and I am going no where.

After the first patch the game would crash maybe ounce every ten plus games I played. Yes there were a few other things like sound cutting out when in a vehicle. The game is, no doubt, buggy but I have not had as near as a bad experience as you claim to be having. After the third patch it has gotten a lot better. I know when I join a game on a friend they crash. Other than that I have not had any crashes.

Maybe you are having problems due to SLI. That is why I decided on the 780 because I wanted a single card for less hassle after my experience with crossfire.

Yes it IS that bad, SLI is broken... With that happening running @ LOW settings and what looks like 9 colors in the game it's awful

huge chunks of the terrain flashing as well seizures will set in soon

Damn, I did not know it was that bad with SLI. Is it EA's fault that SLI does not work or is that NVidia's. NVidia updates the drivers which includes handling DirectX and whatever they have to do for SLI. So is EA or NVidia not using DirectX correctly or is NVidia not implementing SLI correctly? Since I am not having any problems without SLI we can safely say it is a SLI issue which is NVidia's fault.

What graphics card do you have? You should turn off SLI or try only one card and see if you have any problems. I know you do not want to roll that way but try it and see if there is a difference.

That is why I swore to never use multiple GPU ever again. The Titan was expensive at $1000 but the 780 was $650 and came close. EVGA's 780 ACX is overclocked and beats or ties the Titan and was $700 so I got that card. It is a single GPU and satisfies my FPS at 2560x1600 with highest settings. That card can handle all games at that resolution. I don't have to worry about micro stutter or other issues multi gpus have. In fact that card performs the same as 780 Ti which costs more and is driving down the 780 ACX to $525. Man. I could have saved $200 had I waited a few months. lol That happens.

That sucks man. Hopefully NVidia fixes their drivers.

No, it's anywhere. Lying about things like for a public company amounts to fraud. It's not because people got a buggy game for $60 but because people bought and sold the stock, possibly in the millions of dollars, based on misleading information.

EA is nothing but in the wrong here and I would think even people in the more liberal places in the world would agree wholeheartedly so I really don't understand your stance at all. You must not know anything about this topic.

No you missed the point. No one would sue for this in another country. The US is the land of litigation.

lol, kep telling yourself that. Companies being sued because they didn't sell as many tablets as people expected, or people being sued because they said sorry after an accident.

What a load of crap. This could, does and should happen in any country.

This is just so wrong it's not even worth replying to you any more. As others have said.

MikeChipshop said,

I have to prove that other countries have law suits? Really?

Way to miss the point.
Litigation exists in other countries, OBVIOUSLY. But for this sort of case? No, it'd be laughed out of court.

No you missed the point because you seem to be quite narrow minded. If you think that this sort of case only exists in America then you are a) Sorely wrong, and b) blind to the truth.

The onus isn't on me to provide proof of some thing you refute.

Mr. Hand said,
Is it really that buggy?

It's probably the least stable game I've ever owned (14 years of playing online multiplayers)
When it works it's actually a lot of fun but it "works" approximately 10% of the time. The rest of the time it's either truly farcical hit detection (we're talking like 1 second removed from reality) or crashing. It's essentially impossible to recommend it when it's a coin flip that anything will happen even if you're shooting a guy in the face (and getting the hit markers).

Mr. Hand said,
Is it really that buggy? Similar topic - has anyone had a lot of issues with Assassin's Creed IV bombing? I have the XB1 version.

It likes to crash if the video settings cause it to try to fill more video ram than you really have. Eg you can't run High or Ultra on a card with 2GB video ram without it crashing randomly. You must set it on Medium even if the card would be capable of higher otherwise.

EA lost my money after they badly botched the release of BF3. There was a lot wrong with it, and unfortunately, they seemed prone to catering to trolls.

What do you mean by "catering to trolls"?

By the time I stopped playing BF3, it was so watered down thanks to constant complaining that one package was too powerful than another.

They were also tweaking it to bring in the Call of Duty players which I think was a mistake in itself. Both games are First Person Shooters but they have their own sub-market to go in and to try to steal the players from the other market could alienate everyone they already have. I think they did actually manage that too...

Honestly.. They had one chance to lure all the fed up CoD players away and they botch that too. EA is nothing but a money sucking black hole. Fifa 14 was also horribly arcade-ish after advertising that it is a soccer simulation game. I think BF4 is the last straw for me.

Did you notice that they cheated on the player models? There is 1 model per team and it is duplicated among all players for that team. I played the demo at Gamestop on the PS4 and it stuck out to me for some reason. Other than that the players did seem to have independent A.I. but in the past they still had a different model for each player.

Didn't really notice, but that doesn't bother me as much as (and I'm assuming you're talking about FIFA) the fact that the over-head lobbed passes over the defence are always ****ing perfect, and the fact that if its someone like C.Ronaldo, he cannot be caught or tackled. Its just a ridiculous game with no structure or emphasis on build-up play.

Sue EA. its evil. two things made all good game company's going out of business. online piracy and EA. along with SOPA there should have been SEAA as well

"The investor has alleged that EA knew about Battlefield 4's issues but directed the blame towards Sony's firmware"

When the game all ALL platforms is one big massive buggy mess lmao EA... its always someone elses fault!!

bobsled said,
Crossfire issues. How is that EA's fault? AMD create the profiles...

Sorry, SLi AND Crossfire. Both AMD and nVidia are having issues now after the latest update (not driver related). The game has been broken since day one no matter how you look at it.

Edited by HoochieMamma, Dec 19 2013, 12:07am :

It would be nice if EA took note of this and gave developers the time they need rather than forcing it out the door at the deadline... but hey this is EA there's no profit in delaying a cash cow.

Even fixing bugs can't be rushed, because developers, instead of understanding and fixing actual problem, would use "sweep under the carpet" bug-fix technique, which is simple warping the issue into try...catch block and ignoring it; a lot of these and it gets worse - program won't crash, but will slow down due to internal crashes and be full of weird behaviour.

Doubt anything will really happen, commercially I really don't think the bugs will really harm the share price or revenue of EA. Also even if it did no action would still be taken unless the game was basically nothing like it was presented.

The bugs don't really matter. It's the lying about them that's the problem here. You can't do that as a public company as people are making investment decisions on those statements. It's the same thing Elon Musk is being sued over in multiple cases right now.

Because EA has such a good revenue lately?
