OpenAI recently posted on X that it worked with the Estate of Martin Luther King, Jr., Inc. (King, Inc.) to ensure that the late civil rights icon"s image is treated with integrity on its platforms. At the estate"s request, OpenAI has currently paused any Sora generations depicting Dr. King while it says it is implementing stronger guardrails to prevent misuse.
The company posted on X:
The Estate of Martin Luther King, Jr., Inc. (King, Inc.) and OpenAI have worked together to address how Dr. Martin Luther King Jr.’s likeness is represented in Sora generations. Some users generated disrespectful depictions of Dr. King’s image. So at King, Inc."s request, OpenAI has paused generations depicting Dr. King as it strengthens guardrails for historical figures.
While there are strong free speech interests in depicting historical figures, OpenAI believes public figures and their families should ultimately have control over how their likeness is used. Authorized representatives or estate owners can request that their likeness not be used in Sora cameos.
OpenAI thanks Dr. Bernice A. King for reaching out on behalf of King, Inc., and John Hope Bryant and the AI Ethics Council for creating space for conversations like this.
Dr. King"s daughter, Dr. Bernice A. King, has previously spoken about the importance of protecting her father’s legacy from distortion or commercialization. OpenAI said that she was directly involved in discussions with the company, along with entrepreneur John Hope Bryant and members of the AI Ethics Council, to establish more respectful practices for representing historical figures.
Generative AI tools like OpenAI"s Sora, along with Google"s Veo and even Meta, are redefining how we create realistic digital media. But alongside that, creativity raises concerns about deepfakes, image rights of important people, and the need for consent.
While some figures do have estates and foundations managing their image rights, many don"t, which leaves their legacies vulnerable to misuse.
In the United States, laws surrounding a person"s likeness (also known as rights of publicity) differ from state to state, and the boundaries become blurrier after someone"s death. Some estates, like that of Dr. Martin Luther King Jr., take an active role in managing how their loved one’s image is used, working to prevent distortions or misuse that could tarnish their legacy.
For OpenAI, though, which has already faced scrutiny over content safety in its models, this move seems like an effort to balance creative freedom along with responsible use. The company recently announced that it will allow adult conversations, including erotica, on ChatGPT with its "let adults be adults" principle.
While OpenAI did not exactly specify when Sora"s guardrails would be updated, it said that it will continue dialogues with historians, ethicists, and communities to ensure that the representations of leaders such as Dr. Martin Luther King Jr. remain accurate and dignified.
