Unlocking an iPhone

I know there will probably be a lot of accusations of shady stuff but my question is simple.  I have a friend who horribly lost his brother.  He would like to be able to take any information (pictures and such) from his iPhone, which is locked with a passcode.  The police tried using his thumbprint after the fact but it didn't work.  Will Apple unlock a phone under a situation like this, with corroborating evidence and all, of course.  If not Apple, anyone else?  The police already said they couldn't, which I figured.

Depending on what iOS version is on the phone, there may be no way for Apple to unlock it.  Further more, you cannot connect it to a computer to use a program such as iTools to extract anything from it until you unlock it.

Does it backup to iCloud or iTunes?  If it does and you have his apple id and password, you could restore the most recent backup to a different iDevice.  That's the best answer I can give.
