Earthlink Dsl misled subscribers file lawsuit

California's Earthlink DSL subscribers are displeased with the ISP's quality of service. They claim Earthlink's network was unable to handle their demand, thus falling short of what they expected. The law firm Stull, Stull, and Brody which represents the earthlinks dsl subscriber party has filed a class action lawsuit against the ISP. They claim Earthlink violated the Consumer Legal Remedies Act and the Unfair Business Practices Act. "Specifically, the complaint alleges that Earthlink did not construct a telecommunication infrastructure sufficient to meet demand for its DSL service," the law firm stated. "As a result, Earthlink was unable to provide the degree of DSL service performance capabilities and attributes that it marketed and advertised."
