Sperm donor sued by Kansas for child support

By 2009, when lesbian couple Angela Bauer and Jennifer Schreiner decided they wanted to give birth to a child, the two had been together eight years and already had fostered and adopted several children together.

The couple tried its luck at Craigslist, posting a $50 ad for a sperm donor to help them conceive a child.

Finally, they received a response from Topekan William Marotta. He described himself as a 43-year-old man standing 6 feet 1 inches tall and weighing 205 pounds. The email stated he was reasonably fit and in good health, with blond hair and blue eyes.

Marotta wanted to make sure the child he was helping bring into the world would be taken care of, Bauer said. He didn?t want to be involved in the parenting, she said, but was open to meeting the child later, if he or she had questions.

The couple was successful the first try, and a baby girl was born to them on Dec. 7, 2009, though only Schreiner?s name appears on the birth certificate. Kansas law doesn?t recognize same-sex unions.

Today, that child is in the middle of a state lawsuit. The Kansas Department of Children and Families has filed a child support claim against the sperm donor for the couple?s now 3-year-old girl, despite a signed contract waiving his parenting responsibilities. A hearing in the case has been set for Jan. 8 in Shawnee County District Court.

The Kansas Department of Children and Families became aware of the situation because Schreiner had to file for Medicaid to secure health insurance for the girl. Bauer, who formerly was the breadwinner of the family, was diagnosed in March with a serious illness, rendering her incapable of working.

i know this must be horrible for the couple however, this is another reason you always go through an agency for these things.

I think it's important to post the last few lines of the og post. Sure it has nothing to do with the man, but it my shed some light as to why the state of Kansas is going after the donor.

Bauer and Schreiner split up in December 2010 but continue to co-parent their eight children, who range in age from 1 month to 25 years.

OK first off, that letting that woman be considered a dude when she still as her parts is everything wrong. Second, It's the women's fault, the dude shouldn't have to pay anything. If I did, I'd demand parental visitation. Third, society will get worse with this type of nonsense.

The State is going after him, not the woman. It is also the man's fault since he went along with this nonstandard sperm donor deal.

Here is what i get from the story.

Two women wanted a child and asked for a donor which they got

They split up but still raise the child (see no problems here)

They dont mind the donor being involed and believe he would be good too for the child

Bauer fell ill who was the main bread winner (financial difficultis maybe)

Kansas dont want to help out so are saying the contract is void because they were a gay couple and he has to pay child support

So thats what i got from the story other than Kansas were fine with the two women having a child tillBauer fell ill and they saw they "might" have to help out with child support. This is nothing more than a pure greed case in my honest opinion especially when the women have helped out with fostering kids too 8 in fact. I guess this is what happens when you help out.

i read something recently on this type goverment action. there are many states that have some obsure law that mandated them when goverment assistance is requested like for medicaid to go after the closest relative using what ever law fits the best. or something close. i read the earlier article once so...i am no lawyer. it also mentioned parents and children as in elder parents mainly when the parent gets put in a home and the kids ignore them. with angry white men calling the shots with state budgets i bet we see more of this.

This is pretty standard in most states actually. Place a child on medicare and they are going to try and find out who the boy in the situation is and make him pay (unless you go through a proper sperm donor agency). They probably asked her who donated the sperm and she told them.

The article tries to spin it like it is the lack of gay rights in Kansas that caused this "inconvenience" for this guy. Marotta could have found himself in the exact same position if Bauer was a sterile male and Marotta donated sperm to Bauer's wife in order to have a baby. Of course, Bauer as a man could have adopted the child immediately thereafter so maybe not...
