thank you windowsX, you did not RIP anything. the version like that isn't even out yet so yeah... anyways, heres my verdict.

andy, ur a homo. u ripped his work, plain to the eye. try to make ur OWN theme newb, copying ppls exact things isn't very sportsman like, although this isn't a COMPETITION for christ sake ppl!!!

windowsX has all the right in the world to make the theme, andy can copy his theme to make his OWN mockup as long as he doesn't release it to the public saying that he is to credit.

windowsX, the credit goes to you. END OF STORY!

1) Extract my resources with StyleBuilder

2) Open my themes

3) Copy some of my resources to his theme

4) check theme property to suite it with his theme (like turn off word in keynote and and start button contentmargins in slate for example)

5) Modify his own theme after he has ripped some of my work like his rendition toolbar based on my idea and start button

6) Test it with my shellstyle

7) Make a screenshot and post it here

personally i think arguing over this---without any proof---is very sad. remember windows x used to compite with alan whatever. that's just sad. i am not against to windows x but really, it's just sad. i feel sorry for him

Didn't I tell you I'll stop this? I know that this can't prove anything even he really ripped or not but I feel so bad with this so I want to say something for this. And I believe that every themer wouldn't feel OK for his work was ripped or something like that without permission. So I want to clear my mind up from this situation. I'm sorry for my post as I told you before that there's no one who wanna see this kind of reply. I won't care of this anymore. Really!

For Alan, it's his misunderstanding that he think I stole his idea. Now it was cleared with my witness thread to prove him that I planned it since March.

What a sad thread. There's valid arguments to support both sides of the argument (basically, rip or no rip) - but certaintly no proof that Andy's ripped Windows X's work, so why are some assuming the worst in him? Guilty until proven innocent?

And I believe that every themer wouldn't feel OK for his work was ripped or something like that without permission.

I hear ya, I really do (I've had my work ripped before). But there's no proof, and it's a strong possibility that he HASN'T ripped your work. So until there's evidence or a solid argument to the contrary, your posts are nothing more than unfounded attacks.

That's my opinion, anyway. I'm not trying to take sides, btw.

I do not like intervening in people affairs, however I will in the odd chance that this might change your attitudes.

Myself, y_notm, and another member of this board, all made .net/longhorn/blackcomb themes for WindowsXP around 2 years ago

1. When themes first because possible

2. When the first mock up shots of Longhorn were posted over the net.

Now there were 3 of us, making themes off the same mock up pics, and the exact same resources.

We didnt run around spamming the boards about whos copying who, hell we near released them at the same times, we made out own additions to it, and we kept updating and improving our theme to outdo the others. It was friendly fun, competition that resulted in a golden age of themeing. Back then those were the 3 most downloaded themes for quite some months.

Even uptil the first proper alpha shots of Longhorn, there were dozens upon dozens of themes based off Longhorn, and the EXACT resources we used to create our themes, and still did you see us running around detracting from threads about it. No.

The fact is with this whole Longhorn theme, some authors seem hell bent on having the definitive Aero or PDC or Keynote theme, that will be like the definitve Watercolour theme by Binary. We that will never happen again. Binaries theme is the definitive watercolour theme because at the time, there were not enough authors around to have several authors working on the one same theme.

I mean WindowsX you were almost on the right path, go! go and update your themes, out do the other guy, without being nasty about it, theres always more thaty can be done to improve a theme or TFP, Binaries watercolour wasnt complete and a close as possible replication on the first or second releases. It took him well over a year to refine it to the level he did.

My point is, this happens, hell I created a HTML version of MCE, and the Whistler 2250 Active desktop. Then Xero came along and with the help of some russian guy, made it in Flash etc, but at the end of the day I created the first HTML, and I wasnt happy that he stole my thunder, but the fact is both versions had their good and bad points, and quite frankly his release pushed me on to update my HTML releases time and time again.

Again, as people have pointed out, no one owns this theme, its out in the wind, so just do your different versions, and push yourselves on to better them.

Because quite frankly both WindowsX and ANDYs again have good and bad points, and they each have their own followings. So lets keep these threads what they are about.

I don't know what the big deal is, they don't look even similar. Maybe its just me but the colour is completely different, caption buttons are different, startbutton is different, my caption bars have a slate/plex gradient effect not flat like yours, my startpanel has a screwy black line around the user pic(yours doesn't), taskband program highlights are completely different, and my captions and taskbar are way thinner.

same think as i would rip neowin site then add some gradient effects, change color and everyone will think ive chaged the world !!

dude if i was you i would admit that i used some ideas then ask windows x for permission and im sure he would be happy to give it to you, he is a great guy. :rolleyes:

I like how it looks.

Windows X : I really like you transformation pack and I am using it currently. I love your work.

ANDYLOGO : I really like what you have done. The black line you have around the display picture I find actually looks better. It gives it sort of a 'shadowed' look which what I like.

Back At Windows X : I feel bad if he stole your work cause I really enjoy your stuff.

I'm not going to take sides on this whole 'stolen, not stolen' cause really I like them both.

I hate to weigh in on this argument but im afraid im going to have to agree with the whole ask for permission thing.

I still ask for permission even when the images are barely recognizable anymore just as a matter of courtesy.

I happen to know first hand that WindowsX and myself put a lot of creative thought and effort into our keynote style startmenus.

I am also more than happy to give permission to people who want to mod or use my work and I am quite sure WindowsX would be too,

The important thing is that you actually ask before you make a public spectacle of it ..

ANDYLOGO you have great skills but in the future get your permissions taken care of before you post these [WIP] topics and we will all have an easier time getting along :)

my only advice to you is maybe talk to windowx aobut this and maybe you two could end up making a(n) Uber-Theme by both of you...i would LOVE to see that

anyway just try to settle the difference and understand the main reason he gets mad....hes still in school and this is probably his favorite thing to do, meaning he loves it....i dunno that really didnt make sense..... anyway post some more screen shots damnit and lets see how ur theme is doing now

This is a good theme, it's not a rip. Of course they will look similar, they are trying to copy the same thing!

The Shell is the same, but ANDYLOGO already said it wasn't going to be included.

This is a bunch of crap, a perfectly good thread ruined.

    • This got me thinking, would you rather a self driving car prioritise protecting its passengers or everyone else? I'd choose the one that keeps me and my kids safest.     • The proportion (or number of iterations) has nothing to with this aspect of Copyright I am describing. In short, it doesn't matter how many times the manager tells you to change something or how. Your work product is always YOURS until and unless you then assign that to the person representing the client/company, usually for financial compensation -- either in salary or as a subcontract work for hire payment. if iterations determined copyright, then businesses would have learned to just keep making changes until they could claim they owned the copyright, without having to compensate the artist for their work. And that would be BAD. The only place where the amount of changes does have a role is in how much does a human modify a previous public domain work (from any source) before it is considered fair use or their own work, etc. For example, if a human makes substantial changes to a public domain (re: AI, by definition) work, then they can then claim that derivative work as their own...but NEVER the original version, of course. That's why anyone can make a movie about Dracula, for example, as long as it is based on the public domain novel, but not if they take new ideas from copyrighted movies made afterwards. As one of the people who personally advised the US Copyright Office on their recent ruling on these very issues, be assured that I specifically used the terminology precisely -- though I made it simple enough for laymen to understand it. If I made this confusing by doing so, I apologize. But, to be clear regarding your assumption that I would agree to your second statement that I quoted above -- the answer is NO. If AI does the work, no matter how much "direction" you give it, it cannot be copyrighted. All AI generated content is in the Public Domain and therefore the copyright cannot be assigned to ANYONE, even you -- until and unless substantial modifications are made to it BY A HUMAN BEING (yourself or a contracted artist/writer/etc.) and then that copyright on the derivative work is legally (in writing) transferred to you. This is a critical distinction. And it is important that people, especially AI sloppers, understand this. For example, YouTube is not paying AI slop generators for the copyright, etc. of their AI slop. What YouTube is doing is sharing AD REVENUE for permission to publish your AI slop. Copyright/ownership/rights never come into it. Importantly, that means that anyone can copy any AI slopware on YouTube, etc. and rehost it anywhere they want, even back on YouTube, and there is nothing legal that YouTube can do about it with regards to copyright protections, ownership, DMCA, etc. Anyone is legally free to use any AI slopware in any way they want. When this ruling was pending, I warned Disney legal of all of this before they did their OpenAI deal -- that it would literally dilute their entire IP portfolio forever. They ignored that warning for the PR and stock bump. But that is why, when the ruling came down last year, Disney quickly extricated themselves from that OpenAI deal, even eating the initial upfront fees -- followed closely by OpenAI ending their entire AI video generating business model. They adjusted their PR release dates to make this less obvious to shareholders, of course. Phew. I hope that this clears up the key distinctions for you and anyone reading. If you have any additional questions or even hypotheticals about AI and Copyright, please feel free to ask.
