Sony sued over Killzone: Shadow Fall's graphics

Sony Computer Entertainment America has been hit with a lawsuit alleging "deceptive marketing" of Killzone: Shadow Fall because the PlayStation 4 game's multiplayer mode does not run at the resolution advertised.

 

The suit, filed by California resident Douglas Ladore in Northern District California court, alleges that Sony advertised Killzone: Shadow Fall would run at native 1080p resolution but "used a technological shortcut that was supposed to provide 'subjectively similar' results."

 

In March, Eurogamer's Digital Foundry analyzed Shadow Fall's graphics and reported that the PS4 game's multiplayer component runs at 960 by 1080 resolution ? as opposed to 1920 by 1080, or 1080p resolution ? with a "high-quality temporal upscale."

 

The lawsuit alleges that Sony advertised ? through videos, its official website, social media and Killzone's retail packaging ? would offer 1080p graphics. "Unfortunately, Sony's marketing and on-box representations turned out to be nothing more than fiction," the lawsuit says.

 

 

 

 

 

The lawsuit alleges that "'temporal reprojection' is not the 'native 1080p' that Sony promised" and that Sony has not updated its packaging and marketing to reflect the game's actual resolution. Class allegations in the suit include negligent misrepresentation, false advertisement, unfair competition and fraud in the inducement. The amount sought in the suit exceeds $5,000,000.

on one hand yeah it is false advertising. on the other though, who the hell even cares? it's not that great of a game anyway (then again most "realistic" style shooters are stale anymore)

The issue is false advertising, when companies can get away with it on a regular basis, it's a bad thing. 

 

I wish we had something similar to United Kingdom's ASA in the United States.

I love blurry to the point of distraction, and the in depth report of going into best buy.

The box is going to have 1080p on it at least because of SP. Jeez Xbox 360 boxes had 1080p on them as the device had a hardware upscaler.

Sure Sony should have explained the tech to the geeks sooner, but lawsuits and false advertising is a waste of time. Aliens Colonial Marines was false advertising, did that even get a lawsuit?

I do want the person filing the lawsuit to win. I've had it with literal lies that publishers make and polish up videos prior to sales, then they limit reviews until after release of the game so you will go and buy it based on deceptive and false advertising and of course the hook is that retailers won't take back the game after it's been open.

 

We should all sue them for selling us a supposed "full" product but we end up being beta tests at $60 a pop. 

 

It's really getting out of hand these days.

Exactly.    1080p on box means it is outputting actual 1080p to the TV.      It is not a guarantee that it is not unscaled inside the console!   

All it means that the signal is 1080p to TV

 

This is pretty idiotic to think he will get his $5M.

Single player is true 1080p too.

 

And the description about him buying the game made me LOL

welcome to pretty much every PR promo, IMC for MS and Sony prior to the launch of their consoles. This generation was overrun by lame marketing phrases such as "nextgen" and they blatantly said sure " 1080, no problem". What a load of bull.

This case should be thrown out but Sony should get a slap on the wrist for playing with the numbers a bit. Still, no one got hurt and no one deserves $5 million in compensation for something like this.

 

Otherwise, I'm going to sue Nintendo, because they promised me that the N64 would have dinosaurs like the ones in Jurassic Park.

I always thought this argument was silly before but now it's hit an absurd level.. it's called marketing. You want hard data do your homework, should never take a commercial at face value.

I always wanted to sue them too because of Duck Hunt on the NES. Cost me a few TV's, damaged from thrown light guns at that f'ing dog.

It's because Sony listed the game on their website as being 1080p/60....   for about a day.  Spread across the internet like wildfire, Sony took it down, Ubi then confirmed 900p/30.  All before release.

How stupid. There wasn't any false advertising.

There was false advertising from Sony and even after the whole thing somewhat blew up they continued saying it's 1080p. This lawsuit is still stupid though.

Seriously if you are going to try to take this stance like it is a crusade or some kind of cause, be consistent and do it across the board and at the very least pick a better game. 

 

Or you could always join the adults who realize marketing is in fact just that, marketing. Anyone who is capable of looking at things objectively know that companies are always going to do whatever they can to make their products look better than they actually are. I mean seriously, do you watch the trailers for the upcoming Assassin's Creed game and think that is what it is going to look like on either the PS4 or XBox One? Or do you have enough sense to know they are showing it on a development kit with everything maxed out to look as good as it possibly can look?

 

This is literally no different than seeing an advertisement for a Big Mac, or hell even the picture on the menu as you are standing in line, and wanting to sue McDonalds as the real life Big Mac looks nothing like the one in the commercials.

 

Nevermind the fact that the SP portion of Killzone is actually 1080p, so it really was the dumbest game they could have chosen for this supposed "lawsuit."

 

GIve me a break.

 

This whole lawsuit is an absolute joke. Let's pretend for a second it actually does somehow win. What exactly does that gain the consumer? Trailers and screenshots that are an actual representation of the final product? Some text on the box that claims it is actually running at 900p but is upscaled to 1080p instead? Like none of that information is widely available as soon as the game is released, if not weeks before it is released?

 

Every single industry does false advertising, every single one. If you are somehow gullible enough to fall for it, who exactly is to blame again? The company that is doing the same as every other company out there? Or the people that somehow think any marketing they see is going to be an actual representation of the final product.

I think the lawsuit is silly, but then I also think the obsessing over resolutions and frame rates got out of hand too. That has led to people taking it far too seriously and then suing companies over it.

 

Luckily, I think the tide is turning online and we might be near the end of that kind of over blown emphasis. Unfortunately, the damage is done, trickling down to the masses and it will take a while for it to pass from there.

I think I'm going to sue Sony because the game graphics for my old PS1 games don't look as good as the pre-rendered CG cut-scenes they put on the game cases...(sarcasm)

not only community - Sony has contributed to the whole "resolutiongate" with tweets and interviews and offhand comments. It was good marketing so can't really blame them.

 

Last gen Sony camp was obsessed with the "Power of the Cell" and this gen it is 1080p/60fps. Life goes on as usual. :)

      The concern of this article is not getting "hacked". No one is taking over my Google account and anyone that was is far away from self-hosting their passwords. It was about your big tech account of choice deciding to reduce features or getting out of the password manager business altogether. Bitwarden (or say Proton) is professional security company offering opensource solutions. They are going no where and one can easily download or export their passwords to another password manager service regardless. They again also offer self-hosted option. I doubt many people were sold on this solution based on the write up. The author had a number of warnings and caveats themselves. A local, self-managed solution is not for 99% of users.

      I've owned nothing but ATi/AMD GPUs since 2002, after my last nVidia GPU in 2001 (3dfx before that), IIRC, and in all of that time I recall getting this error maybe once, certainly no more than twice. Despite all the scuttlebutt as to how poor AMD drivers are supposed to be that has certainly not been my experience at all... Usually it has been a configuration problem of some kind. Then again, since we're dealing with OS versions that are EOL, it could easily be an OS version discrepancy. It's still weird to think that Win11 has been officially out for more than five years!

      AI will never be the jobs panacea some companies fantasize about today. Oracle is likely using it as an excuse, which we will see a lot of companies doing, I'm certain. They love their "plausible" excuses for their downturns. A couple of weeks ago my wife asked me to call Krogers about some discrepancy in a online grocery order, and it will be the last time either of us does that. I'll just do emails with humans from now on... The AI experience was horrible--the obviously recorded voice started asking a bunch of questions about our orders six months prior(!) and saying, "Is this in reference to your order on January 6, for $****?" You say "No!" and immediately the next question is "Is this in reference to your order on January 29th, for $****?" again, I answered "No!"--and it was incredible--on and on it went like that for fully 20 minutes until we finally got to the present, and only then was I put through to a human with authentic intelligence... I wondered why on Earth the idiot AI didn't start with the most recent orders and work back from there, as it was something anyone with a functioning brain would have done. And why didn't the AI have enough sense to ask me what the problem was in the first place? It didn't take too much deduction to understand that the goal of this "AI" was to cause the person on the phone to hang up in disgust, with no resolution of the problem. That begs another question: why pay for a tool-free problem line if the goal is to avoid solving your customer's problems?... Fortunately, Krogers does have real humans capable of reading an email and understanding it, and if she sees another situation in the future that's route she or I will take. The online grocery delivery service from Krogers has been great, over all, but their AI truly sucks.
