Kobe Accuser: Show me the Money!

Recommended Posts

The 20-year-old accuser in the Kobe Bryant case filed a civil suit Tuesday seeking an unspecified amount in monetary damages from the basketball star, saying that he has a "history of committing similar violent sexual assault on females."

The civil suit, labeled "Jane Doe vs. Bryant," was filed Tuesday in federal court in Denver, the court assigned to Judge Richard Matsch.

The suit claimed the Los Angeles Lakers star raped the woman after she went up to his room when he was staying at the Vail-area resort where she was working. The claim that she was raped while bent over a chair matches the criminal charge against him.

The civil court filing says:

On June 30, 2003, at approximately 10 p.m., Defendant Bryant registered as a guest at the Lodge and Spa at Cordillera, a resort hotel located in Eagle, Colo. The Plaintiff was employed as a front desk clerk at the Cordillera Lodge and Spa.

After his check-in at the Cordillera Lodge and Spa on June 30, 2003, Defendant Bryant, out of the hearing range of his agents and bodyguards, asked Plaintiff to come to his room to escort him on a private tour of the resort hotel and its facilities.

Plaintiff agreed to Defendant Bryant's request and during the tour of the hotel, Defendant Bryant flirted with Plaintiff and she was flattered by his comments and interest in her.

After taking Defendant Bryant on an approximate 15-minute tour of the hotel facilities, Defendant Bryant asked Plaintiff to escort him back to his room.

After she entered his hotel room, Defendant Bryant asked Plaintiff to join him in his jacuzzi but Plaintiff declined his offer, informing him that she needed to clock out of work.

After Plaintiff declined Defendant Bryant's offer to join him in his jacuzzi, Plaintiff attempted to leave the hotel room and Defendant Bryant blocked her exit from the room, asking her for a hug.

Plaintiff hugged Defendant Bryant and he then began to kiss her lips and neck.

After a short period of time kissing her, Defendant Bryant's voice became deeper and his acts became rougher as he started touching Plaintiff's breasts and groping her in her genital region and buttocks.

When Defendant Bryant began touching Plaintiff's breasts and groping her in her genital region and buttocks, Plaintiff immediately asked him to stop and informed him that she needed to leave the hotel room.

Defendant Bryant refused to allow Plaintiff to leave the room and stood between her and the room door.

Defendant thereafter physically restrained Plaintiff with force and violence against her will by choking her with his hands around her neck while bending her over a chair in the hotel room.

Defendant Bryant pulled his pants down and lifted Plaintiff's skirt, pulling down Plaintiff's panties while continuing to restrain Plaintiff by physical force and a perceived threat of potential strangulation if she resisted his advances.

With (sic) she was bent over the chair and forced by Defendant Bryant to remain in that position, Defendant Bryant sexually assaulted and raped Plaintiff, by unlawfully and knowingly inflicting sexual intrusion and penetration of her vagina against her will and without her consent in violation of the laws of the State of Colorado, including in violation of C.R.S. 18-3-402(1)(a) and 4(a).

You guys don't seem to understand the difference between compensatory damages (75,000) and punitive damages whose ammount have not been stated.

For example if someone damaged your property, compensatory damages would equal the value of said damaged property. Punitive damages are monies awarded to discourage said conduct.

For example say a person dies from cancer which the plaintiffs believe was from tobacco, they sue the tobacco company for compensatory damages to cover medical, funeral, and other related bills. They also sue for punitive damages for the death of their loved ones and the tobacco companies disregard for the safety of their customers. Reminds me of some John Grisham novel but I cannot recall which one. Actually in the John Grisham novel it was an insurance company, the compensatory damages covered the costs associated with the dying mans cancer treatment etc, the punitive damages were for the insurance companies business practices which ultimately lead to his death. In the movie the compensatory damages were fairly low, however the punitive damages were in the millions.

i believe on Colorado that the limit on punitive damages for this civil case at least would be 750,000. so when it's all said and done, even after lawyer fees, Kobe won't be hurting financially.

while i don't think he raped it, i think she did it willingly then screamed rape and money after the fact...i think she's stupid as hell to file a civil suit and ask for money before the crminal suit is even over. that just shows everybody that you only care about the money. if you were really raped and felt that raw about it, she would have been like, no i don't want the money (at least right now) i want to see justice done and i will see the criminal case through to a conviction...now she's just a golddigger.

I guess you'd have to look around but from what I've read punitive damages cannot exceed compensatory damages in Colorado, which would total 150K, under certain circumstances that ammount can be tripled, worse case scenario looks like 300K.

No matter how you look at it he won't be hurting financially, hell 60 million in punitive damages and he'd still have another 60 million left at least considering his recently signed contract.

I think it's more about loosing a civil case and some people believing him to be a rapist.

Do you actually think she has the money to keep going through trial paying lawyers and whatnot?

Do you actually think she has the money to keep going through trial paying lawyers and whatnot?

The state of colorado is making the case, she just has lawyers because she thinks she needs them.

Honestly, she is looking pretty bad now, espically since the trial hasn't started yet :/

    • Let's goooooooo! I've been loving the entries so far! I still have to finish Rebirth (things have been busy!)! Excited for this next installment.
    • "Revelation?" I was hoping for this episode to be called "Reunion". Oh, well... In a related note, the Final Fantasy VII compilation has received an EC entry, short for Ever Crisis. For those who don't know, it already had AC, BC, CC, and DC entries, short for Advent Children, Before Crisis, Crisis Core, and Dirge of Cerberus. I hope it doesn't get an FC entry becaude that would be a freakin' crisis.
    • Uh, after intense testing now, 'Samsung Browser' is not the best one outside of 'Microsoft Edge' after all. Opera Air is that. It has "some" bloat, but it's far less than what both Microsoft Edge and Brave browser have.
