The differences between these two styles are marginal if you ask me, people will always try to replicate looks and add their own style, this doesnt make it a rip imo, its someone elses interpretation.

this gradients @ taskbar are useless if user's taskbar is more one row vertically

Load up Firefox, it really throws the toolbar layout real bad. :(

Also, just my personal taste but I don't like the mouseover affect on the start menu, maybe try for a dull white for the mouseover instead?
