I could see this being debated. When you take a picture with your camera, technically you have a copyright on that picture. That picture isn't human made though. It was made by a machine that was controlled by a human. You could make the same assessment about AI probably.
I'm not agreeing or disagreeing with the judge in this instance, but perhaps the thinking is that it is reasonable fair use to train on the books (read them), whereas he said they cannot store the books and I assume they cannot quote them beyond a point to a user. Of course, there are many problems and questions here. Is there anyway to stop the systems from storing the books even though they aren't supposed to? Is there anyway to prevent a user from manipulating an AI system to get it to do something that it isn't supposed to do (fetch an entire book)? We know these systems have these sort of problems where they can be massaged to do things they have measures in place not to do.
Wasn't the Perplexity CEO who says they want the browser to literally hoard ALL of the user data and use it to power their Ai ######? You have to be insane to use their browser.
So, they can steal whatever they want, sell subscription to their service which wouldn't be able to exist without ALL the content they've stolen. How does that make sense? That's not "fair use".
