i was in a pretty bad accident

i was hit in the back in the highway at full speed then crash another car

Heres The problem

i have a lawsuit against the guy that hit me. but he is saying that i hit him.

well now i find out that he got a lawsuit against me

Police Report dont show any fault on anybody

What will Happen????

If 2 people suing each other?

I dont know about other countries, but in Australian law, if it's a pile up, the person at the REAR of the crash is legally responsible for everyone else.

I'm not sure if its the best place to ask for qualified legal advice, do you have a lawyer you can ask?

I believe even if the person in front slams on the brakes for no apparent reason, and someone hits them, the party that hit is automatically at fault. How can he claim that you hit him going backwards? That utter nonsense will be thrown out once it has an initial hearing.

Call a lawyer either way, unless the other guy does not have one...but you run a risk of not properly arguing your case.

that's right. had such an accident too. usually means the guy behind was speeding or didn't have enough distance to you. he's partwise guilty at least.

Dosn't pileup mean more than two cars? so should it be the second car (aka the one that hit the first car) because from my understanding most of the others would be because they had no time to stop or tried to swerve to avoid it.

Seeing your from new york. Its highly likely the person that hit in the back will be put at fault under review by a judge. Regardless how the cookie crumbles.

Now seeing that your story is true, countersuits are typical. Did the guy that hit you have the lawsuit against em before or after the crash?

i made my lawsuit the same day

started therapy the same day also

i go to therapy everyday now

my back is killing me

im stress out cant sleep

no work in 3 weeks

no insurance money yet

If you got hit from the back doing 60 I would not sweat it AT ALL! I dont see any rear end damage but if its there your in the clear.

Insurance money can take a few weeks (did for my friend that totalled a passat).

Not quite right. In a pileup without witness', it would be determined on a per car basis.

Car 1 ------ Car 2 (Respon for Car 1) ------- Car 3 (Respon for Car 2) etc.

An accident report along with pictures and witness testimony should be all you need. You need to relax, you cant think straight worrying like you are.

would they take a look my car did take pictures???

It depends on the situation. Many factors.

And why are you sueing? Just goes to show the world yet another civil lawsuit in US. Perhaps the US is the capital country of lawsuits. I'm so afraid to go to US, that if I touch anyone there, they'd get a lawsuit for millions of dollars against me. :p Thousands of cars get into crashes everyday, many much worst then what you experienced. How bad damaged is your car? Do you both have insurance? Then use it.

You say you got hit in the rear left at 60 mph? And if there is someone at fualt the police report would show that and seeing as how you can see fire trucks and the such in the other pictures, I would assume the police where at the scene and talked to witnesses and both drivers so they should have deteremined whos at fault.
