FRESNO, Calif. -- Police arrested a 54-year-old man Saturday night for carrying a shotgun disguised as a Super Soaker water gun.

Officers on patrol saw a Randy Smith carrying what appeared to be a Super Soaker water gun on a rifle sling around his neck, Sgt. Rick de Jong told the

But when the officers got closer, they realized the toy had been turned into a home-made shotgun, de Jong said.

"He took the Super Soaker apart, was able to fashion a barrel to where he was able to make what's considered a zip gun, where you can fire one round through it," Sgt. Mark Hudson told

The weapon was loaded with a 20-gauge shotgun shell.

Smith was booked into the Fresno County Jail on charges of being a convicted felon in possession of a firearm and ammunition, and manufacture of an illegal weapon.

My dad was a sheriff's deputy that was on patrol for years. He found a shotgun made from PVC pipe on a biker he pulled over. People come up with some crazy stuff.

The only illegal part is that its barrel and its overall length are also too short under Federal law; the limits are an 18" barrel and an overall length of 26".

It could be legalized by filling out some papers at ATF and paying the $200 tax on a Class 3/NFA weapon - just as you'd do to legally own a machine gun, grenades, etc.

Yeah shotgun shells seem like they can be fired from anything even a mouse/rat trap.

Not for THIS guy...He was "a convicted felon in possession of a firearm and ammunition". Didn't matter what papers he filed or what fees he paid, he couldn't have it.
