The penalty phase of jury deliberations starts next week and Tsarnaev is eligible. If the jury returns a death sentence Federal judges rarely deny it .

The Antiterrorism and Effective Death Penalty Act of 1996 bans successive habeas corpus petitions for those under federal terrorism death sentences, so if sentenced to death his route of appeals will be far shorter than in state death penalty cases.

Most recent Federal death sentences have been carried out by lethal injection.

BOSTON (Reuters) - A jury on Wednesday found Dzokhar Tsarnaev guilty of killing three people and injuring 264 in the 2013 Boston Marathon bombing, as well as fatally shooting a police officer four days later.

Tsarnaev, 21, was found guilty of all 30 counts against him, with 17 of the charges carrying the death penalty. The same U.S. District Court jury will now decide whether to sentence him to death or life in prison without possibility of parole.

Tsarnaev silently looked down, occasionally fidgeting, as the lengthy verdict was read. The courtroom was packed with survivors of the attack, the parents of 8-year-old Martin Richard, the youngest fatality, and law enforcement officials, including former Boston Police Commissioner Ed Davis.

Well, absolutely no one to blame for that but himself. He's 21 years old, the defence that he was doing so because of his brother was never going to work.

Oh sure. But that doesn't change my statement. At 21 years old (or 19 years old when he committed the crime?) he was most likely well aware that he wasn't going to survive. Either K.I.A. or via the death penalty, he will have understood that.

He wouldn't be sucking air, having human contact, enjoying his meals, reading, or otherwise enjoying life to the degree prison allows. All good IMO.

Killing Breivik wouldn't make anyones life better, it wouldn't solve any problems and he certainly isn't enjoying prison life, not even in comfy norwegian prisons.

Yeah, I remember him bitching about not being able to play the latest games a couple of years back. The inhumanity.

that's one person, and you're assuming a killer and psychopath is talking truth.

 

being locked up and not able to do whatever you want whenever you want breaks you. thinking otherwise and worse thinking you need to hurt and torture or better yet kill people for justice makes you a pretty terrible human being, technically a psychopath as well.

People on death row cost considerably more than people that's serving life in prison without parole. The whole death row complex and the appeal process cost many times more. You should also never kill a terrorist, especially not when they are backed by extreme muslims since it becomes a part of their agenda. They say that martyrdom is achieved when you either kill yourself for God or when you're punished with death when you do God's work. He should NOT get the death penatly, anyone who says that he should are ignorant about the fact that his supporters will celebrate more if he's killed than if he has to serve life in prison and die in misery. If someone is caught alive, don't kill them. When it comes to non-terrorist acts, the death penatly is still a very bad idea due to much higher cost and the probability that you've caught the wrong person is still too great for capital punishment to be used. Capital punishment should not be used if you don't have the justice system straight out of a utopia. Innocent people are put on death row and put to death when they've plead innocent all along and their innocense is proven too late. Anyone who promotes capital punishment should be put on death row for that very reason, allowing terrorists to get their way or allowing innocent people to actually waste a ton of tax money and then get killed. Capital punishment is STUPID no matter how you put it! Putting someone to death ends their misery, punishment should feel like a punishment until natural death. If the  justice system was fool proof then capital punishment would've been executed within a few days.

- Do you want to go along with the terrorists' agenda and allow a terrorist to achieve martyrdom?

 

Lock him away and make people forget about him! THAT'S punishment, it feels deep inside the convict but it's also partially reverseable (you can't give back lost time nor repair psychological damage).

The justice system IS NOT fool proof! Anyone who thinks that it is, is a complete FOOL!

Correct. This is a Federal case so the State courts are cut out of the appeals chain. He'd also get just a single habeas corpus hearing instead of judge shopping for near-endless ones.

IIRC his appeal will go to the District Court for the District of Massachusetts, then the Court of Appeals for the First Circuit, and finally the US Supreme Court which is very likely to dismiss it without a hearing. They don't have to take up every appeal.

You should give him the "best" punishment. Don't please the supporters. Kill him and he reaches martydom and that's ranked high (in goodness) among people like him Don't please the terrorists.

Just put him in prison, and then put him in general population.  He wouldn't last long.

 

 

It's kind of strange that people who oppose the death penalty use the argument that it is cruel when the fact is living the rest of your life in the prison system is probably infinitely worse.

 

There are valid reasons to oppose the death penalty, but the act of execution being cruel isn't really a particularly good one when you consider the horrifying state of most prison systems.

If you kill him, you martyr him and he wins.

 

If you throw him into a toilet of a jail, like Guantanamo Bay (a prison for terrorists) for the rest of his life, he's not going to be enjoying himself at all.

    • Personally, I’ve found that it’s usually worth investing in the infrastructure you don’t want to replace later, especially cabling. Running Cat6A (or better, depending on your needs) during an upgrade is relatively inexpensive compared to having to re-cable a few years down the road. For switches I try to balance current specs with realistic growth. If my budget allows it Ill choose switches with higher uplink speeds which leaves room for expanding later on, but I don’t necessarily overspend on access ports if the endpoints won’t benefit from them anytime soon. One lesson I’ve learned is that planning for scalability pays off. It’s much easier to add devices, VLANs, or higher-bandwidth workloads when your network infrastructure already supports it than to replace hardware later.  What is your budget like?
    • I hate the term, "future-proof." We saw it back in the 90's / 2000's, if not before. You cannot future-proof anything, since there is no definition of how far into the future you plan on prepping for. I worked for a company where their engineers still used XP, and when asked why it was because their sensor software wasn't compatible with newer operating systems and the software was discontinued so they couldn't upgrade the software.
