This article's author need to learn to read. The more I look into it, the dumber it gets. From the original law: "makes a telephone call or utilizes a telecommunications device, whether or not conversation or communication ensues, without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person at the called number or who receives the communications"

So the author thinks it's ok to anonymously email a woman and tell her all the nasty things you want to do to her, but it's not ok to call her, by law? They just added in internet because it wasn't covered before. What a joke.

people who have a problem with it lack a common sense factor. If you want to "bully" or otherwise harass someone and not want to disclose your identity, then that deems you as cowardly. Kinda childish in my opinion.

I really don't care either way for the law because it really doesn't affect me in any way because I am not one of those sad trolls who sits around toying with people

So I disclose my real ID under that law, I get fined under a different law.

I dont disclose my real ID, I get charged for that law but nobody knows who I am, and therefore is unable to charge me for feces.

Actually Neowin is owned by the esteemed Neobond, who is fortunate not to live in the US.

And for most of its non-USA members, they are free from teh law.

This only applies to US-Based forums.

If I am a US citizen and post here, I am in trouble.

If I am a non-US Citizen and post on an america-based forum, the forum is in trouble for letting me post that (depending on state laws and whether forum accepts all responsibility or not)

If I am a us-citizen and flame on a us-forum, we are both in deep sh!t :p

The actual law reads like this:

SEC. 113. PREVENTING CYBERSTALKING.

(a) In General- Paragraph (1) of section 223(h) of the Communications Act of 1934 (47 U.S.C. 223(h)(1)) is amended--

(1) in subparagraph

(A), by striking `and' at the end;

(2) in subparagraph

(B), by striking the period at the end and inserting `; and'; and

(3) by adding at the end the following new subparagraph:

`? in the case of subparagraph ? of subsection (a)(1), includes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet (as such term is defined in section 1104 of the Internet Tax Freedom Act (47 U.S.C. 151 note)).'.

(b) Rule of Construction- This section and the amendment made by this section may not be construed to affect the meaning given the term `telecommunications device' in section 223(h)(1) of the Communications Act of 1934, as in effect before the date of the enactment of this section.

Personally, I don't see a problem with this, even though I do think it was a waist of tax payers dollars. According to the article, this law prohibits "posting annoying Web messages or sending annoying e-mail messages without disclosing your true identity." This could help fight SPAM, you know, those dreaded emails that everyone gets but doesn't want.
