Driver kills dog, then sues owners for damage

Im curious. If this was a toddler instead of a dog, would he have still sued? Would opnions on this board be different?

false analogy, a toddler isn't property, a dog is.

but even if it was a toddler, and the exact same thing happened (i.e. it ran out onto the road unsuspectingly to drivers), opinions shouldn't be all that different.

You should keep in mind, of course, that toddlers who can't comprehend "road: danger!" won't be running all that fast, and the parents would have had time to stop him/her anyways. and you can't seriously suggest that parents take the same amount of care with their kids as with their dogs.

Why is a toddler not property?

I can suggest that. My mom was a crack head. She treated us like dogs.

Can't see a mini pinscher doing that much damage to a car, also what speed was he doing if this little dog created so much damage, and he wasn't able to stop.

Also he can't claim the excuse of not using the car to work, he should have insurance for this if he relied on his car for his 2 jobs.

So any good attorney should be able to get this lawsuit dismissed, while I also feel the owners of the dog would have no right to counter sue.

Correct, why should the driver have to fork out for damage to his motor vehicle that he did not cause.

In the UK and I guess every other country that has Deer in large concentrated numbers, you see a sign telling you to slow down and be carefull.

Not where I live! Not every country or smaller forms of government (city, county, province, etc) has the same laws.

His insurance should cover this anyway.

There is no reason for the owner of the dead dog to pay. Accidents happen. If the dog bolted out, yes, bad on the owner, but we all know, we arent in controll of everything we have/do/whatever. The guys insurance should cover this, enough loss already.

As much as I agree, he is human and prone to mistakes and not only that but he can't react instantaneously and stop his car on a dime!

I think that in Spain it might be even illegal to let a pet dog 'out'. Especially when roads are involved.

I remember I was once in a bus, a dog ran "by" the bus, the bus driver didn't see it coming, and the bus ended hitting the dog (some headlight broke). Anyway, he suddenly stopped the vehicle (as he barely knew what had hit the bus) , and and old lady fell from her seat and hit the floor really hard.

Next thing I saw, the pet owner running away. He had just let two dogs out, one ran fast and hit a bus, and the other was with him I think. Well, as soon as he saw what happened, he ran away. We spent like 15 minutes right there checking if the lady was okay.

Dogs can run pretty fast, WAY faster than a toddler, so there's no comparison. Not to mention that responsible parents usually take care of their children! And it doesnt take that long for a kid to realize what a road is and how dangerous it is!

Unless you're driving really fast, you can anticipate a toddler walking at regular speed (inside a city/town). In faster roads, why would there be a toddler there?!
