And what if she wasn't 14, what if she was a little kid who ran out in front of the car, we wouldn't be having this conversation... People think they can put the blame on younger people because they "listen to loud music" and "don't respect their elders" but when it comes down to it, it was 100% the driver's fault, "vehicular manslaughter", UT announcer etc... Granted, she could've been more careful, but what if this was in a quiet neighbourhood where there was rarely any cars. The article does say it was in a residential area, there could well have been younger children playing near the street, the driver took none of this into consideration...

little kid - the parents are to blame they should be keeping an eye on such a young child - 100% the child/parents fault

the fact is she was 14 and she was listening to music and not paying attention to the road shes more then capable of looking for cars and she knows all about how to cross a road the problem is she didn't

in this particular case half of it was the fault of the driver the other half is the girls fault

to say its 100% the drivers fault would suggest that the girl was powerless to prevent this from happening no matter what which is a complete lie

if the driver saw wasn't speeding then they would of been able to stop in time (hopefully?) i'm not sure where they got they noted him at driving 40mph so maybe there was another person who could have helped prevent it?

if the girl looked left and right then theres a good chance she would of seen him and thus could of waited

however i do agree we have no idea where this occured maybe she did look left and right and there was a tree or something blocking her view of the car in which the tree would also be to blame and should be cut down

or perhaps he came flying up hill who knows one thing is for certain though she would of heard a car if she wasn't listening to the music which would also have helped her survival

i'm not generalizing her like that at all

the music would of hindered her ability to hear the car properly and the reason i emphasize loud music is because if its not loud then she would of heard the car :) thats just logic

we know nothing of the girl and if she respects her elders or not and so we can't make that judgement

yurithedragon post explains just that "use your eyes and ears" our eyes are only line of sight and our ears are well omnidirectional they could of saved her

30mph is comically slow though.

the speed limits need updated and raised in my opinion. 70 on a motorway...what a farce. should be able to do at least 85

The problem isn't with increasing the speed limit, it's how do you slow down in time when you're travelling at the increased speed. Increased speed gives you less time to react to anything up ahead. A lot of people think they're a better driver than they are, that they will be able to deal with any situation that comes up, but as you see on BBC News etc every week thats not the case.

The problem is not just the fact that she didn't look both ways. The other danger is listening to music too loud on the streets at a level that you can barely hear cars pass by unless they're close.

I see idiots riding their bicycles with their earbuds or headphones. They're just asking for an accident.

I won't presume to think the girl was jaywalking, but the bottom line here is, this kind of thing can be avoided completely if both pedestrians and drivers simply OPEN THEIR F**KING EYES and act safely. TOO MANY TIMES do i see pedestrians carelessly running or walking across the street, wrongly assuming they have the right of way, even when they're jaywalking. TOO MANY TIMES do i see careless drivers occupying their attention by talking on their phone or texting, putting pedestrians at risk. PAY ATTENTION, PEOPLE!

We have designated, sign posted speed limits for a reason too...

Less than 10 over the limit isn't that much... especially KPH. He was going 6MPH over. I do that daily.

Not crossing in a designated area... such as a crosswalk or sidewalk.

You can get a ticket for it, but its never really enforced.

He was doing just under 40 MILES PER HOUR. We don't have jaywalking laws in this country...

EDIT: what, are there roads that are illegal to walk on?

Oh too many ifs and buts here. Too many permutations spoil the broth. I feel ok when her friend wrote she died a hero - a great martyr for the ipod. Next time we will see limited edition ipods released with her initials engraved or something.

ipod has nothing to do with the accident. everyone know that before crossing the road one has to check his right and left sides. and she obviously didnt do it.

A little while ago I saw some guy nearly get run over by the car in front of me, he had his ear phones in and was staring down and his music player or phone, stepped right out into the road without looking, luckily the other driver was aware of him.

While it was unfortuanate the guy was going over the sign posted speed when the accident occured, the girl should have paid more attention to what she was doing.

Weather the guy was doing "slighly under 40" or 30mph, he couldn't stop the girl from stepping into the road before she had looked.

As always, the driver gets penalised and will probably get put in prison for something not entirely his fault.

I'm sure children under 14 are taught how to cross cross a road safely.

I know I was.

Its both their faults, speeding and not paying attention.

I've nearly been hit by a car on my street at this one corner where I always forget to look, but whenever walking to Uni ro somewhere, I cross where I know it is safe and I can easily see whats coming, and also usually at the lights.
