because the anti-MS fanboys (trollboys?) don't want to accept the fact that MS was perfectly in their rights to do this, so we have to bring in something totally un-related to try and convince them.

The people who write the software get more then their share.  That's not the issue, the issue is with MS putting rediculous limits on something you bought for the ultimate intent and purpose of making more money.  I guess the 50 somewhat billion they already have isn't enough.  Then they thank the very people who keep them alive by sueing anyone who tries to sell their software.  Yeah, that's great business ethic.  :rolleyes:

Tell that to my dad, MS threatened to sue him when he posted a laptop on ebay that came with windows preloaded on it.

You're allowed to sell the laptop with preloaded software, the o.e.m. licence says you must only use the software with the machine it was built with, so your dad has 2 choices, sell with software or without, doubt many would buy a second hand laptop without and ops on it.

Show us the threat received from M$ please.

in that case, he could be sued if they want after him for the right damn thing. They just seemingly picked the most pathetic sounding excuse of a lawsuit ever and went with it.

I may be confused but...

How is reselling software that is clearly licensed only for students and teachers legal?? It's not like he was verifying that the winners of his auction(s) were indeed students, correct...?

Microsoft purposely sells their software at extremely discounted rates for academic users and this guy was taking advantage of that.? At least, that's what it seems like to me.

One of my jobs is a sales assistant at a well known technology retail store. Whenever we sell academic software (such as Office, Windows, etc.) we'rnotu> required to ask for student I.D and other retail stores such as Harvey Norman and Harris Technology don't do this either.

I'm not sure if its the same in the U.S. however if we're not required to do that, why should someone else have to demand for Student I.D?

As much as I hate and loathe MS and their crushing idiology. I still realize that I wouldnt be typing this message without them. To be honest, I feel that MS is doing something good here. They need to protect themselves. My first reaction was, MS should lose, but I have changed to the kid should lose. He is moron for doing this. But oh well. So I guess what I am saying is that I support MS in this lawsuit.

Well that's not what MS claimed. This was many years ago, I don't have access to the email.

allow me to make this simpler for the fanboys to understand: WE KNOW THAT WHAT THE STUDENT DID WAS ILLEGAL what we are saying is that microsoft is greedy. when you "buy" their software you arent actually buying it. you are giving them money so they can give you a disk and tell you how to use it. think of it this way, its like buying a wrench and finding out you can only use it on one thing. sure it could be used on a thousand things but that would be illegal wouldnt it :rolleyes: . hell, your not even buying the wrench, you buying a licence to use it!

Troll fights (especially ones involving MS) usually break down into a argument involving flawed analogies with cars because the people using the analogies are a bunch of rice kids. It's best to avoid the thread at that point...

UPDATE: After the news broke, Microsoft offered to settle with Zamos.

Meanwhile, the company's lawyers seemed to understand they'd created a PR nightmare. "I got a call from Chudakoff [lawyer] in the early afternoon, the day the story came out," says David Sr. "He was looking for my son, and when I asked him what for, that cockroach said he couldn't discuss the case with me, because it defies legal ethics. So I said, 'What legal ethics?'"

When Zamos finally talked to Chudakoff, his tone had changed. "He was very complimentary," Zamos says. "He said he was impressed by my pleadings. His flattery was ridiculous."

This is from the same lawyer who initially threatened to repossess Zamos's Ford Escort as partial restitution (actually an illegal act, Zamos discovered).

In case you're wondering, Zamos had attempted to return the software to the university (they refused), attempted to return the software to MS (they also refused, despite the license agreement stating otherwise) before putting it on eBay (which has a MS-approved policy allowing resale of academic versions).

His argument was that he could not possibly accept the EULA because he never opened the package to install the software. Therefore, he could not be legally bound to it. (which is valid)

Further, the corporate lawyers said, ``Microsoft has suffered... substantial and irreparable damage to its business reputation and good will, as well as losses in an amount not yet ascertained.''

hahahAHAHAHAHAHAAAA - are they kidding?

Suffered? I bet all those copies that he sold or whatever would never have been missed by Microsoft if they didnt know about it!

I have done alot of thinking on this whole MS power struggle thing and how they seem to monopolize and how I hate them for it, etc. My conclusion is this: I must use Windows to run all the programs that I want to run in Windows and that only run and work in windows, so thus, I must support them. (damn, i know why I spent that $100).

SO...GO MICROSOFT...KICK SOME NARLY butt. HEHE, GO MS!!

Lawsuits are all about establishing a precedence. Microsoft doesn't care about this guys money. But, take this guy times 2million college students, and, you have a -real- potential for lost money.

All this serves is to deter people from doing the same thing. It's called smart business.

Did you know that Bill Gates is the wealthiest person in the world? You dont get to that point by not being smart about business.

haha fine if you want to think of it that way, does your insurance cover one car only, or all your cars..

ONE CAR. you have to buy seperate insurance for EACH car..so whats so different from that and software licenses? plus..insurance is so expensive =\
