
Windows Server is a core product in Microsoft's ecosystem, designed to manage and host enterprise infrastructure at scale. Although many customers prefer deploying it in on-premises environments, they also have the option to leverage cloud infrastructure to achieve the same purpose. Now, Microsoft is facing a lawsuit for overcharging customers regarding the use of Windows Server on cloud platforms.
Reuters reports that a $2.8 billion lawsuit has been filed against Microsoft in the UK for charging local businesses extraneous amounts of money when using Windows Server on competing cloud platforms like AWS, Google, and Alibaba Cloud. This class-action lawsuit represents 60,000 businesses who were impacted by Microsoft's alleged unfair pricing.
At a hearing last year, the plaintiff claimed that the prices of Windows Server on Azure are lower than rival platforms, so the extra cost has to be unfairly transferred to the consumer. On the other hand, Microsoft argued that the case should not go to court at all since it does not show detailed calculations that indicate any alleged losses to businesses. It also claimed that its existing business model, which licenses Windows Server to rivals, actually benefits the competition. Ultimately, London's Competition Appeal Tribunal has decided that the case must at least go to trial, which is a significant, but early, victory for the plaintiff.
Of course, some may argue that it's natural that Microsoft charges more on competitor services as it encourages customers to switch to Azure for a more "native" experience, infrastructure-wise. However, to others, including the plaintiff, this strategy unfairly transfers the cost to the innocent consumer who primarily wants to use the services offered by other cloud platforms, and only uses Windows Server when it comes to Microsoft's offerings. Of course, the court will ultimately have the final say, but it could set up important precedents regarding how Microsoft carries out its business practices in other regions around the globe too.
